Terms Of Use
By using our services or "Site" ("www.ShopZar.com", "ShopZar"), you signify you understand and agree to be bound by the terms and conditions of this TOS (Terms of Service) Agreement.

The terms and conditions of this Agreement are subject to periodicly change at ShopZar's discretion, with or without notice. As such, each user of our services ("Member", "User", "Affiliate", or "You") agrees to review this Agreement periodically.


DEFINITIONS

  1. "Point" - A non-monetary value awarded to a Member for using the ShopZar network
  2. "Earnings" - A point value awarded to a Member for using ShopZar
  3. "Raffle" - A group of Members that compete for a prize
  4. "Lottery Pool" - A group of Members that partner up to increase their chances to win a Lottery
  5. "Cashout" - A request made by a Member to trade a Point value for a monetary value paid by ShopZar


MONTHLY BONUSES

Bonuses will be awarded to members whom reach certain spending levels (not including travel sites) during any month of the year. Monthly bonuses will be paid out in points, and credited to a qualifying member's account on the 15th of the following month.


REFERRALS
The Member will earn 10 percent (%) of the referee's point earnings on all purchases. The referee must create a unique account with ShopZar for a commission to be rewarded to the Member. All account spamming is strictly forbidden, and will result in immediate account termination.


RETURNS

In the result of a return, any point balance earned from the specific order will be automatically deducted from the Member's accont. If the Member does NOT have enough points in his/her account to cover the value of the return, a temporary hold will be placed until the appropriate value can be recovered.


DISCLAIMERS AND LIMITATIONS OF LIABILITY
ShopZar is not liable for any malfunction or failure of its systems, Site or service offering due to matters including, but not limited to, force majeure, the failure of ShopZar's or any other entity's software, hardware or communications technology or any part thereof, delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system, any act of God, any outbreak of hostilities, riot, civil disturbance, acts of terrorism, the acts of Government or authority (including refusal or revocation of any license or consent), fire, explosion, flood, theft, malicious damage, strike, lockout or industrial action of any kind.

ShopZar assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text or images.

It is your sole responsibility to understand and abide by any federal, state, local or foreign tax laws that may apply to any monetary value awarded or prizes won from using the ShopZar service. You understand that you may be required to complete certain Internal Revenue Service ("IRS") tax information reporting forms prior to your receipt of any monetary sums. You further understand that ShopZar may be required to provide information regarding your earnings to the IRS or any other foreign government agency that requests such information concerning its citizens.

THE MATERIALS IN THIS SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. SHOPZAR DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE CONTENT OR OTHER MATERIALS IN THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, SHOPZAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL SHOPZAR BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, SITE OR ANY DOWNLOADED MATERIALS, EVEN IF SHOPZAR OR ITS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SHOPZAR BE LIABLE FOR ANY DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, OR OTHERWISE) FROM THE USE OF THIS SITE


TRADEMARKS, COPYRIGHTS AND PROPRIETARY RIGHTS

You may not distribute, modify, transmit, reuse, re-post, or use the content of the Site for public or commercial purposes, including the text and images without ShopZar's written permission.

The trademarks and logos displayed on the Site are registered and unregistered Trademarks of ShopZar and/or others. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of ShopZar or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in this Agreement, is strictly prohibited. You are also advised that ShopZar will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.


POINT USAGE

Lottery Pools
  • Lottery pool tickets will be purchased from the Illinois Lottery. Currently one or more out of the Big Game, Lotto, Powerball, Little Lotto, and Pick 5 will be available to play. ShopZar will decide the game and the lottery date. Game information will be posted in the Member's account manager.
  • You can join a ShoYou can join a ShopZar lottery pool by placing a qualifying order ($10.00US cash-back or more), or by using your Member Points. No cash, credit card or check will ever be accepted. The point cost to join a ShopZar lottery pool varies, and will be posted before entering.
  • All Participants must be 18 years and over to join a lottery pool. Therefore, no point winnings will be awarded and paid to a winner under 18 years old.ool entry will be closed 24 hours prior to the draw date and time (e.g. if draw is on January 2nd 2009 then entry will be closed on January 1st 2009 at 10:00PM). After the pool is closed, and before the draw time, lottery tickets will be purchased by ShopZar on behalf of the lottery pool members. The number of tickets purchased will be based on the size of the total number of Members that joined the pool. All ticket images will be posted online before and after the draw of the lottery.
  • ShopZar's administration fee for each lottery pool is 35% of all accrued winnings. The remaining 65% will be divided up among the lottery pool's Members.
  • Each member of a winning lottery pool will be awarded a point value based on their total stake. A Member's lottery pool stake is equal to the total number of entries the Member ordered divided by the total number of entries in the pool.
  • Returned orders, before or after the pool date, will result in the absolute forfeit of all awarded lottery winnings (no exceptions).

Cash Out 

  • 100 ShopZar Points = $1US
  • You must be an individual, 18 years of age or older.
  • A Minimum of 2,500 points ($25US) is required to cashout. We will ask you to verify your full name, mailing address and phone number the first time you submit a cashout request, and it will be stored in our database.
  • In the event of a large cashout request, you may be prompted to provide us with your SSN/TaxID (for tax purposes).
  • The cash out amount will be paid by company check or official bank check.


TERMINATION

ShopZar, in its sole discretion, may disqualify a Member from participation in the use of any or all portions of the Site if such Member engages in any conduct that ShopZar deems to be illegal, improper, unfair or otherwise adverse to the operation of the Site or detrimental to other users of the Site. Such improper conduct includes, but is not limited to: falsifying personal information required during account creation; sending spam emails; accumulating earnings through methods such as programming techniques or falsified information; intentionally trying to defraud or otherwise tamper with the computer programs or Member information comprising the Site. ShopZar may void and refuse to pay/reimburse to a Member any monetary sums that a Member has earned and/or require the return of any monetary sums that a Member may have accumulated if engaged or previously engaged in improper conduct. Members further acknowledge that the forfeiture of earnings or deposits shall in no way prevent ShopZar from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.


MISCELLANEOUS

The Member acknowledges that if any provision of this Agreement conflicts with any other rule, regulation, term or condition of the Site, the terms and conditions of this Agreement shall govern
